A motion was made by Alderman Torina, seconded by Alderman Bell that this  
Committee Report be Approved by committee. The motion carried by a unanimous vote.

2.  
Liquor and Tobacco Advisory Board recommends approval for the Sale of Tobacco  
Products in conjunction with a tobacco store in a C-4, Urban Mixed-Use District at 714  
Broadway (Damian Lyman/Lyman Enterprises dba Dolla Dame Smoke Shop/Applicant)  
There was no motion, or votes on this item. It will appear on the next scheduled Code &  
Regulation Committee agenda.

Liquor and Tobacco Advisory Board recommends approval for the Sale of Packaged  
Liquor (Class PKG) in conjunction with a grocery store in a C-2, Limited Commercial  
Zoning District at 2614 and 2600 Kilburn Avenue (Somabhai Patel/Shiv Dristi, LLC dba  
Jasmine Pantry/Applicants)  
A motion was made by Alderman Bell and seconded by Alderman Logemann. Ald.  
Logemann and Ald. Prunty voted in favor of the request for the sale of liquor. Ald. Bell,  
and Ald. Torina voted "No," and with a 2-2 vote, the  
item failed.

Committee recommends sustaining the Zoning Board of Appeals’  
approval for the Special Use Permit for a Planned Unit Development for  
an RV and Fifth Wheel only community in an R-1, Single-Family  
Residential Zoning District at 2530, 2710 and 2720 South Main Street  
(Midwest Yard Holdings, LLC/Applicant). Subject to conditions.

A motion was made by Alderman Torina, seconded by Alderman Logemann, that this  
Committee Report be Approved by committee.  
Ald. Torina stated that she had spoken to Attorney Rodriquez, and the developer  
concerning the proposed project, and the developer has agreed to increase the  
displacement funds for the residents, and he has also agreed to give the residents more  
time to find new housing. Ald. Torina noted that while she doesn't like the thought have  
having people being displaced, she does feel better about being able to get the residents  
more money and time for the move. She thanked her colleagues for their support, and she  
gave Ald. Granath a special thank you for enlightening her more about camping culture.

Proposed Lift-Assist Ordinance  
A motion was made by Alderman Bell, and seconded by Alderman Torina, that this  
Committee Report be Approved by committee.  
Ald. Beach asked if the fee should be different for businesses as opposed to residents.  
Angela Hammer, Legal Director for the City of Rockford explained that per the statute,  
the ordinance only applies to assistant living facilities, and nursing homes. She further  
explained that the ordinance will allow the City to recover funds allocated for lift assists  
at assistant living facilities and nursing homes.  
Ald.Tuneberg noted that per the ordinance, a charge would be assessed after the sixth  
call. Ald.Tuneberg asked about these type of costs as they may relate to Rockford  
Housing Authority properties. Carrie Hagerty, Finance Director for the City of Rockford  
explained that when the Fire Department is called to RHA properties, the costs are billed  
to the residents not to the Housing Authority.  
Ald. Meeks asked if independent living facilities would fall under the definition included  
in this ordinance. Director Hammer explained that it would be based on a case by case  
basis.

A motion was made by Alderman Bell, seconded by Alderman Torina, that this

Regulation Committee Agenda. The motion carried by the following vote:

III. RESOLUTION  
River District Association & City of Rockford Street Parklet Program  
1.  
A motion was made by Alderman Bell, seconded by Alderman Torina, that this  
Committee Report be Approved by the Committee.  
Ald. Torina wanted to know why was this program only being proposed in the River  
District. Jeremy Carter, Traffic Engineer for the City of Rockford explained that so far,  
the River District is the only organization that has requested this accommodation. Ald.  
Torina asked if it would be better to grant approval one time for this program. Mr. Carter  
stated that this program may not work in all business districts.  
Todd Cagnoni, City Administrator for the City of Rockford explained that the primary  
reason that an approval cannot be given for all business districts is because the City has  
an operating partner who was willing to do due diligence in advance of this item being  
brought before the Committee. Mr. Cagnoni noted that if the Council wished to have the  
parking program in all areas, Staff would be willing to work on it.  
Ald.Tuneberg noted that he knows firsthand that not all businesses want the parklets in  
their areas.  
Ald. Bell noted that this has been done before in the River District, and is being brought  
back. He also commented that he supports expanding the program.
